TERMS AND CONDITIONS OF THE FACILITY
In order to ensure a comfortable and safe rest and in order to avoid misunderstandings, please read the following terms and conditions of stay in Nova Ulinia.
The subject of the regulations are, in particular, the terms and conditions of booking, the rules and conditions of stay, as well as the rules of using the swimming pool, the rules for the sale of Vouchers, the rules for collecting and processing your personal data.
Making a reservation is tantamount to familiarizing yourself with and accepting the provisions of the following terms and conditions, which are an integral part of the lease agreement reached as part of a confirmed reservation, so please read them. The provision of the Terms and Conditions bind all Guests and accompanying persons.

1. General provisions:
1.1. These regulations specify the rules of stay, the rules for providing additional services and the conditions under which you can book a stay in houses (apartments) available within the infrastructure of the facility under the name Nova Ulinia, located at the address: Ulinia 1N, 84-352 Ulinia.

1.3. Nova Ulinia provides the so-called other hotel services consisting in the provision of accommodation in permanent buildings, i.e. houses (apartments) made available to guests of the facility.
1.4. These Terms and Conditions apply to all persons making a reservation or staying at Nova Ulinia. Making a reservation is tantamount to familiarizing and accepting the provisions of these regulations, which is an integral part of the rental agreement, which is reached as part of a confirmed reservation. The person making the reservation is obliged to ensure compliance with the regulations by third parties who will use Nova Ulinia as part of the reservation, including their accompanying persons.
1.5. These regulations remain for inspection in the facility. The content of the regulations has been implicated by Nova Ulinia on the official website of the facility at www.novaulinia.pl, in a way that allows obtaining, reproducing and recording the contents of the regulations using the ICT system used by Nova Ulinia.
1.6. The regulations and rules of Nova Ulinia are in accordance with the current provisions of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2023, item 1610, 1615, 1890, 1933) and the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2020, item 287, of 2021, item 2105, of 2022 item 2337, 2581, of 2023, item 1285, 1414).
2. Reservation of stay and payment:
2.1. Nova Ulinia accepts reservations made through:
1) Recommended, automated reservation system on Nova Ulinia's website, available at www.novaulinia.pl ,
2) automated reservation system available via www.booking.com ,
3) automated booking system available via the www.airbnb.pl portal,
4) automated reservation system available via the portal www.naodludziu.pl,
5) automated booking system available through authorized Google services,
7) making a reservation in person at the Nova Ulinia property.
2.2. Nova Ulinia is not responsible for reservations made outside of the reservation described in paragraph 2.1, except for reservations confirmed directly by Nova Ulinia. If you disclose the possibility of booking at Nova Ulinia in addition to the booking method indicated under point 2.1, it is recommended that you immediately contact Nova Ulinia according to the current contact details available at www.novaulinia.pl and report this fact to the hotel.
2.3. Reservation applies to all houses (apartments) within Nova Ulinia, depending on the subject and scope of the specific reservation.
2.4. Reservations through the automated reservation system referred to in point 2.1 points 1-5 are made by performing activities ordered by the automatic booking system, filling out the registration form and making the required payment of the deposit (prepayment). Payments are made directly during the online booking process. Payment of the deposit (prepayment) is a condition of its confirmation, of which the Guest is informed. Guaranteed reservation is considered to be made only after prepayment (deposit) and confirmation of the reservation by the system or directly by Nova Ulinia. The rules and mode of operation of the automatic booking system are determined by an external service provider within the framework of the functionality and available regulations of a given system.
2.5. Booking outside the automated reservation system referred to in point 2.1. points 1-5 takes place in two stages:
1) Pre-booking, which can be made in person, by phone, or via e-mail. When booking, please indicate the guest's details and contact details for the purpose of accepting the reservation by Nova Ulinia, as well as specify at least the type of house (apartment) booked, the date of stay booked and the number of persons included in the reservation. Preliminary booking takes place after confirming the availability of the house (apartment) and their unit price (price per hotel night or total price) together with an unambiguous declaration of willingness to rent, including determination of the validity of the offer and the amount of required deposit (prepayment) for the booked stay. The pre-booking shall remain valid for a period of 24 hours from the date of confirmation of its terms by both parties and the Guest's declaration as to the will to make it.
2) Guaranteed reservation takes place only after the Guest has made the required deposit (prepayment) for the stay specified at the pre-booking stage. The payment by the booker of a deposit to Nova Ulinia is a confirmation of the guaranteed reservation, unless the parties agree that the booking confirmation does not require a deposit. Nova Ulinia will send you a guaranteed booking confirmation after payment. From the date of confirmation of the guaranteed reservation, the reservation becomes an order and is binding on both parties.
2.6. Nova Ulinia reserves the right to include the minimum or maximum number of days of stay within a given reservation, of which the Guest will be informed at the stage of making a given reservation, but not later than before its confirmation and submission. If Nova Ulinia reserves a minimum number of days of stay, the Guest has the right to leave the property and pass the houses (apartments) covered by the reservation before the end of the last day of stay with Nova Ulinia maintaining the right to the full payment.
2.7. Nova Ulinia is determined individually for each reservation based on the period of stay, duration of stay, number of booked houses (apartments), number of guests, value of selected additional services and form of reservation. The amount of the Nova Ulinia stay for the reservation will be indicated during the online booking process or as part of the pre-booking confirmation.
2.8. Nova Ulinia allows you to redeem discount codes provided only by Nova Ulinia via the automated reservation system on Nova Ulinia's website, available at www.novaulinia.pl. The discount code reduces the total price of the stay within a given reservation by the value resulting from the discount code. The use of a discount code by the Guest requires that the Guest has received proof of receipt of the given discount code from Nova Ulinia, except for discount codes made available as part of generally available promotional campaigns. Unless otherwise stated, the discount code is disposable and Nova Ulinia refuses to reapply it.
2.9. The amount of the deposit (prepayment) is determined automatically or individually for each reservation based on, among others, the total price of the booked stay, the duration of stay, the number of houses (apartments) booked, the number of guests, the value of selected additional services and the form of the reservation. The amount of the required deposit and the details for its payment will be indicated during the online booking process or as part of the pre-booking confirmation.
2.10pm. The amount of the deposit (prepayment) should be paid within 24 hours, unless another date results from the confirmation of the booking online or as part of the pre-booking confirmation. The basic form of payment of the deposit (prepayment) is bank transfer. Nova Ulinia also allows you to pay a deposit (prepayment) in the form of cash, e-transfer or credit card charge at the property. The date of payment shall be the date of crediting the bank account of Nova Ulinia, with the recommendation to send a confirmation of payment (in case of remote payment) or the date of receipt of cash to the Nova Ulinia cash register (in case of personal payment).
2.11pm. Failure to pay a deposit within the deadline specified in the automatic reservation system or pre-booking confirmation is considered to be a cancellation by the Guest from booking hotel services and results in the acceptance that no effective conclusion of the lease agreement has occurred between the parties.
2.12pm. The remaining amount of the Nova Ulinia stay is charged in advance prior to the start of the stay, at the latest on the day of arrival, for a specified number of hotel nights and any additional services. The staff of Nova Ulinia is obliged to reduce the total price of the stay by the amount of the deposit previously paid. In order to clarify possible ambiguities, it is recommended to keep and present a copy of the deposit made or other previous payments.
2.13pm. The fee includes the price of the services included in the accommodation base for the type of reservation. Additional charges apply according to the price list for services not included in the price as free of charge (included in the basic package). The payment rules for additional services specify separate price lists available at Nova Ulinia.
2.14pm. If not otherwise reserved as part of the booking confirmation, the resort fee does not include the resort fee (local), which Nova Ulinia will charge the Guest on the day of departure and final settlement according to the rates and rules applicable during the period of stay at the property in accordance with local law.
2.15pm. Nova Ulinia offers prices in Polish zlotys (PLN). Prices include VAT in the amount in accordance with the applicable regulations.
2.16pm. The basic currency of settlement is the Polish zloty (PLN). With the prior consent of Nova Ulinia, it is possible to settle the stay in a specific foreign currency, but in order to determine the value of payment in foreign currency it will take place at the average rate announced by the National Bank of Poland and applicable on the settlement date, provided that in case of payment other than cash, the object is not responsible for the amount of any exchange rates applied by the Guest's bank, external payment system or the provider of its payment card j/credit.
2.17pm. Nova Ulinia will document each transaction in accordance with applicable regulations. If you wish to document the transaction with a VAT invoice, you must report this fact at the time of booking and provide the data of the buyer. Willingness to receive a VAT invoice must be reported at the time of booking before making the transaction, payment. After closing the transaction with a receipt, it is not possible to issue a sales invoice.
2.18pm. Nova Ulinia reserves the right to refuse to accept the Guest or accompanying persons who during previous stays grossly violated the regulations and rules of stay in Nova Ulinia, in particular by causing damage to the property of the property, Guests, damage to guests, employees of the facility or other persons staying on the premises.
2.19pm. The Guest acknowledges that the deposit (prepayment) constitutes security and then covers part of the costs or damages of the Nova Ulinia facility related to the maintenance of the Guest's reservation and preparation of the facility for the performance of the contract, which consists in particular: booking service in the system; guarantee of exclusivity of the reservation to the Guest; correspondence with the Guest; individualization of the offer; costs of selling and handling payments; physical preparation of premises.
3. Cancellation of the reservation:
3.1. The final and paid reservation is binding.
3.2. In the event of failure to arrive by the Guest within the specified period, the reservation guaranteed with a deposit (prepayment) is automatically canceled due to the fault of the Guest at 11.00 the next day, unless the Guest declares the will to stay in the subsequent booking period and settles the amount related to the reservation.
3.3. Cancellation or failure to make the reservation due to the fault of the Guest, and for reasons beyond the control of the Nova Ulinia property, results in retaining the required deposit (prepayment) by Nova Ulinia, subject to point 3.4., point 3.5 and point 3.6.
3.4. Nova Ulinia provides the possibility for the Guest to change the original booking date of the stay, with credit against the new reservation originally paid (deposit) on another date agreed and available in Nova Ulinia's offer, but not longer than 6 months from the start date of the originally booked stay (changed stay), subject to declaring the will to change the original booking date no later than 30 days before the start date of the originally booked stay (residency changed). The transferred deposit shall each time apply accordingly the provisions concerning the deposit made under the original reservation, including in particular the right to retain it in the event of cancellation of the amended reservation. Changing the booking date updates the price of the stay according to the price of the stay on the date of the modified booking.
3.5. Nova Ulinia will refund the deposit (prepayment) in full if the cancellation is due to the fault of Nova Ulinia due to the termination of the contract due to the exclusive fault of Nova Ulinia.
3.6. If cancellation of the reservation or termination of the contract occurs due to circumstances for which neither party (Guest, Nova Ulinia object) is liable (force majeure), Nova Ulinia will retain the deposit (prepayment) received from the Guest for the benefit of the next possible reservation of the Guest at Nova Ulinia), provided that the Guest informs the property about the obstacle to making the reservation immediately after the occurrence of justified circumstances, but not later than 3 days after the occurrence of the circumstances concerned (i.e. in case of cancellation of the reservation or termination of the contract due to circumstances not guilty by the parties, the Guest is entitled to transfer the deposit for a new reservation at Nova Ulinia if he immediately informs Nova Ulinia about it; no cash deposit is entitled to be refunded). In the absence of informing Nova Ulinia about an obstacle to making the reservation within the required time, the reservation shall be deemed cancelled, terminated or unrealized due to the fault of the Guest. In the unregulated scope, paragraphs 3.3 and 3.4 shall apply respectively.
3.7. The refund of the deposit (prepayment) under the conditions referred to in point 3.5, as well as the transfer of the deposit for the benefit of the next possible reservation of the Guest in Nova Ulinia, referred to in point 3.6. will take place at the request of the Guest in writing or sent by e-mail, with the simultaneous indication of the bank account appropriate to return the deposit (in the case referred to in point 3.5) or indicating new and available in Nova Ulinia's offer reservation date (in the case referred to in point 3.6). In case of cancellation of the reservation due to circumstances for which the Guest is not liable, the application referred to in the first sentence should be submitted on time and contain a justification of the circumstances excluding the Guest's fault in failure to comply with the reservation together with evidence confirming these circumstances, except for the circumstances for which Nova Ulinia is solely responsible, enabling Nova Ulinia to reduce the damage due to cancellation or transfer the reservation — in the absence of compliance with the above conditions, reservations are read for canceled, terminated or unrealized due to the fault of the Guest.
3.8. Nova Ulinia reserves the right to claim from the Guest the repair of damage exceeding the amount of the retained deposit (prepayment) caused by the cancellation of the reservation due to the Guest's fault, but not higher than the total costs of the canceled stay.
4. Hotel night:
4.1. Houses (apartments) in Nova Ulinia are rented for hotel days.
4.2. The hotel day lasts from 16.00 to 11.00 the next day, unless the agreed individual arrangements of Nova Ulinia and the Guest specify different time frames.
4.3. A request to extend the stay beyond the period indicated in the original reservation should be submitted by 09.00 at the latest on the day on which the original date of stay expires. Nova Ulinia will take into account the request to extend the stay if the houses (apartments) are available, with the simultaneous obligation of the Guest to pay a fee for further hotel nights to apply to the current price applicable at Nova Ulinia.
4.4. Nova Ulinia reserves the right to refuse to extend the Guest's stay in the property, in case of failure to make full payment for the previous period of stay in advance and in case of non-compliance with the terms and conditions of use of the property and additional services.
4.5. In case of cancellation by the Guest from further stay during the reservation period, for reasons beyond the control of Nova Ulinia, the fee for unused hotel nights is not refundable.
5. Night silence and stay of outsiders:
5.1. In the whole facility there is a night silence from 22.00 to 7.00 the next day, except for special events agreed in advance with Nova Ulinia.
5.2. Non-external third parties who are not included in the accommodation are not allowed at Nova Ulinia without the permission of the staff. If the Guest obtains such permission, stay of outsiders is allowed only until 21.00.
5.3. Please note that guests may not accept additional third parties for accommodation without Nova Ulinia's consent. Each violation of the prohibition referred to in the first sentence entitles the facility to charge a contractual penalty in the amount of PLN 500 in relation to each unauthorized person and hotel day in which the violation occurred.
6. Using the facility:
6.1. The basis for the guest's accommodation is to present an identity document with a photograph at the reception of Nova Ulinia and signing a registration card.
6.2. In case of particularly justified circumstances, Nova Ulinia reserves the right to change the location of the houses (apartments) in accordance with the established type and standard of accommodation and while making every effort to meet the expectations and preferences of the Guests. The change made will not be the basis for a complaint or a change in the price of the reservation.
6.3. The guest receives at his disposal at the time of accommodation in Nova Ulinia a set of key to the house (apartment) and wicket and a remote control to the gate, which he is obliged to return on the day of departure. Losing or damaging the key or remote control results in the obligation to pay a flat fee of PLN 500 for each piece of lost or damaged key or remote control.
6.4. The guest may not transfer the house (apartment) to other persons not included in the reservation, even if the period for which he paid the fee due for the stay has not expired.
6.5. When handing over the keys to the houses (apartments), Nova Ulinia will provide information about the property and provide instructions for the operation of selected electrical appliances that are furnishing the houses (apartments). This moment is at the same time familiarization with the technical, quantitative state of the house (apartment) and the devices in it.
6.6. Failure to submit comments and objections to the technical condition at the time of introduction into the house (apartment) is tantamount to the fact that the house (apartment) was put into use in a condition not arousing the comments and objections of the Guest.
6.7. During the period of stay, the staff of Nova Ulinia does not have the right to enter the rented house (apartment) without the consent of the Guest, much less move his personal belongings. The right to enter the rented facility is left only in case of noticing threats to the safety of guests, cleaning or in case of non-compliance with the rules of the apartment.
6.8. Changing towels in houses (apartments) or cleaning them during their stay is carried out only upon request for an additional fee specified in the current prices of Nova Ulinia.
6.9. All movable objects located in the Nova Ulinia facility, especially the furnishings of houses (apartments), are owned by Nova Ulinia. It is forbidden to take any things.
6.10pm. Due to fire protection requirements, it is not allowed to use any instruments or apparatus powered by electricity or gas in houses (apartments), which are not the equipment of these rooms and capable of creating a fire hazard, e.g. electric heaters, heaters, gas burners. It is forbidden to bring flammable materials, explosives and materials with an unpleasant odor into houses (apartments).
6.11pm. The guest is obliged after leaving the house (apartment) to protect the premises from strangers, especially by closing doors and windows.
6.12pm. For the sake of the environment and safety of the facility, it is recommended to reduce the use of eclectic energy and water.
6.13pm. In addition to a slight rearrangement of furniture and equipment that does not affect their functionality and safety of use, guests are not allowed to make any changes to the houses (apartments), including in terms of their equipment.
6.14pm. The guest is obliged to take care of the infrastructure of the object made available to him, especially the rental house (apartment), leaving it in a non-deteriorated state when the key is handed over.
6.15pm. Items left by the Guest at the property, after leaving it, will be returned at the expense and risk of the Guest to the address indicated by him. In the event that the Guest does not indicate the address to which the items left are to be returned or in the absence of personal collection of these items by the Guest within 3 days from the date of departure from the facility, the service will proceed with the items in accordance with the provisions on lost or found items. The storage of left items occurs at the expense and risk of the owner. Due to their properties, food items will be stored for a period of 24 hours after which they will be disposed of.
6.16pm. The common relaxation area within the swimming pool is open daily from 10.00 to 21.00. The rules for using the pool are defined by separate regulations.
6.17pm. At Nova Ulinia it is permissible to park vehicles in an unguarded parking area. Each house (apartment) is assigned one marked parking space free of charge as part of the reservation. If available, Nova Ulinia may provide additional parking space for a separate fee in accordance with the current price list of Nova Ulinia. The marked car park can only be used by efficient and non-excessive emission vehicles under pain of removing vehicles at the expense and risk of their owner or owner. It is forbidden to park vehicles outside the place designated under pain of payment of a contractual penalty in the amount of PLN 500 for each disclosed case of non-compliance with the ban by the Guest or third parties for which he is liable.
6.18pm. It is forbidden to light a bonfire in the hearth, fire including as part of a bonfire or barbecue, without prior notification and arrangement with the staff of the Nova Ulinia facility and obtaining permission. The one-time flat-rate cost of a fire in the hearth is indicated in the price list of the Nova Ulinia facility.
6.19pm. When entering or leaving the property, the front door should be closed each time.
6.20pm. The guest is obliged to respect the greenery of Nova Ulinia, especially not to damage trees, shrubs, flower meadows or lawns.
7. Internet access (WiFi network):
7.1. Nova Ulinia provides access to Internet resources in houses (apartments) using STARLINK satellite technology and LTE 4G or 5G (2.4GHz and 5GHz WiFi service).
7.2. WiFi is available free of charge only for guests of Nova Ulinia.
7.3. Nova Ulinia does not guarantee uninterrupted or uninterrupted internet availability. The service may be temporarily unavailable due to technical conditions, telecommunications operators or other reasons affecting the quality of data transmission. Transmission speeds may be subject to limitation, so there may be delays in the actual transfer of data to and from the user's device. Accommodation Nova Ulinia is not responsible for any interruptions in the availability of the service, as well as the quality of data transmission.
7.4. WiFi is used by connecting the device to the wireless network available at Nova Ulinia. A device with a WPA/WPA2 compliant wireless network interface is required to use the WiFi service. Guests at their own expense ensure the possibility of using devices, their protection against unauthorized access by third parties, equipment with appropriate antivirus software and compatibility of devices with WiFi service.
7.5. Access to the network requires authorization. Access authorization is carried out by entering the network ID and entering the password when logging into the network. The data necessary for authorization will be indicated upon arrival, check-in.
7.6. Guests are obliged to use the WiFi service in a manner consistent with the law and good customs and do not pose a threat to the security of the network.
7.7. A guest who violates the rules of using WiFi services may be deprived of access to the services periodically or completely, in particular in the event of:
1) attempt to access network resources to which the user is not entitled,
2) attempts to bypass the security applied to wireless access (i.e. changing the IP address assigned by the DHCP server, using tunnels, etc.)
3) sharing and downloading copyrighted materials (software, movies, music, etc.) from the web, without the consent of the creators ,
4) using P2P applications,
5) further sharing the signal through the use of repeaters, routers, proxies, etc.,
6) running service servers on devices connected to hot-spots,
(7) other activities that may be considered potentially hazardous to the functioning of the network and the users operating in it.
7.8. The Guest bears full legal and financial liability for damages caused by his/her activities using the network.
8. Additional services and services:
8.1. Accommodation Nova Ulinia provides services according to its category and standard.
8.2. In case of reservations regarding the quality of services, the Guest is asked to immediately raise objections to Nova Ulinia staff, which will enable employees to react and improve the standard of services provided.
8.3. Within the Nova Ulinia facility it is possible to take advantage of a wide range of additional services, the terms and conditions of which are not regulated by these regulations are specified in separate price lists and regulations.
9. Ban on tobacco:
9.1. Nova Ulinia is completely prohibited from smoking and similar products.
9.2. The non-smoking areas designated by Nova Ulinia are an exception.
9.3. Failure to comply with the ban will result in the Guest's obligation to pay a contractual penalty of PLN 1000 for each disclosed case of non-compliance with the ban by the Guest or third parties for which he is liable.
10. Animals:
10.1. Please note that Nova Ulinia does not allow pets, including pets, such as a dog or cat.
10.2. Failure to comply with the ban will result in the Guest's obligation to pay a contractual penalty of PLN 1000 for each disclosed case of non-compliance with the ban by the Guest or third parties for which he is liable.
11. Dining:
11.1. Guests at Nova Ulinia can transport breakfast in the basket to the door for a pre-arranged hour.
11.2. In case of taking advantage of Nova Ulinia's gastronomic offer, the Guest is obliged to inform Nova Ulinia about any nutritional contraindications. Nova Ulinia is not responsible for any nutritional contraindications.
12. Rental of recreational equipment:
12.1. Nova Ulinia offers leisure equipment rental for a fee. The type and cost of renting recreational equipment is determined by the current price list available at Nova Ulinia.
12.2. Nova Ulinia is not responsible for the inability to rent recreational equipment due to having it in a certain amount, inappropriate weather and other random situations.
12.3. The rental can only be made by a guest of Nova Ulinia, who is an adult guardian, with full legal capacity, upon presentation of a document confirming identity.
12.4. For one document, it is possible to rent recreational equipment for guests registered in the same house (apartment).
12.5. If the staff of Nova Ulinia considers the Guest to be unreliable, aggressive, under the influence of narcotic substances or drugs, after which it is not recommended or forbidden to use the given recreational equipment, they may refuse to rent the equipment.
12.6. A guest choosing recreational equipment is obliged to check its fit, technical condition and completeness before renting, because he undertakes to return it in a non-deteriorated state, except for natural traces of use
12.7. When deciding to rent equipment, the guest declares that he has knowledge about the care, use and purpose of the equipment and is aware of the risk of injury, accident and damage to property, independently and consciously makes the decision to rent in the state of health.
12.8. The guest is personally responsible for the rented equipment, bearing full responsibility for the damage caused from the moment the equipment is rented until its return, including its damage or disappearance. The Guest is solely responsible for any damage caused to third parties related to the use of rented recreational equipment.
12.9. It is forbidden to transfer equipment to third parties.
12.10pm. If the equipment is left outside the rental, it must be protected against theft.
12.11pm. In case of theft of equipment during the rental of the Guest, he is obliged to immediately notify about the situation of the Nova Ulinia facility and to immediately report the fact of the theft to the nearest police unit.
12.12pm. Nova Ulinia does not accept any liability for accidents, loss of health or death of participants as a result of the use of rented recreational equipment.
13. Guest Responsibility:
13.1. Nova Ulinia is not an adapted property and does not have facilities for minor guests and therefore children over 10 years old are recommended for safety reasons.
13.2. At Nova Ulinia, the full responsibility for children, young people under the age of 18 and persons with disabilities is borne by parents or guardians. Parents or guardians of children are responsible for the safety of children at the property and at Nova Ulinia.
13.3. The guest making the reservation shall be responsible for all persons included in the reservation, pets and the behaviour of third parties staying at the property as invited persons and not covered by another reservation.
13.4. The Guest is fully liable for any kind of damage caused by the operation or omission of it, as well as its accompanying persons or visitors, arising in the property of Nova Ulinia, taking into account damages caused in connection with the use of paid or free attractions offered by the property. Damage means destruction, damage or loss of property of the Nova Ulinia object. The guest is obliged to immediately report the damage caused to the property of Nova Ulinia and to cover all costs of rectifying the damage.
13.5. The guest and the persons for whom he is responsible are obliged to comply with the safety rules and regulations of the law, in particular: health and safety regulations, local law concerning the local fee, fire regulations, provisions of these regulations, and in exceptional situations undertake to comply with the instructions of the Nova Ulinia facility.
13.6. In case of breach of the Terms and Conditions, guests will be checked out and will be required to leave the property immediately. This is especially true for cases of disturbing the silence of the night and any other behavior that prevents the rest of the guests from relaxing. Early departure of the Guest due to violation of the regulations does not entitle him to request a refund of the amount for unused hotel days.
14. Responsibility of the Object:
14.1. Nova Ulinia is liable for loss or damage to items brought by persons using its services within the scope specified in the provisions of the Civil Code, i.e. art. 846 et seq. Civil Code.
14.2. The guest should notify the Nova Ulinia property of the damage immediately after it has been found.
14.3. Nova Ulinia is liable for loss or damage to money, securities, valuables, valuable objects or objects of scientific or artistic value only if these items are placed for safekeeping at Nova Ulinia facility. Each deposit requires specification of the property and its actual value, which may be subject to verification of the Nova Ulinia facility in the presence of the Guest.
14.4. Nova Ulinia reserves the right to refuse to deposit items of high value, significant amounts of money, exceeding the possibility of storage in the property's deposit.
14.5. Leaving personal belongings in common areas such as the swimming pool area is at the Guest's own responsibility.
14.6. Nova Ulinia is not responsible for damage or loss of a car or other vehicle belonging to the Guest, objects left in it or live animals.
14.7. Nova Ulinia reserves the right to perform maintenance and investment work on its premises during the stays of the guests. The area of maintenance and investment works is excluded from access for guests. In the absence of delineation by the facility of the area of maintenance and investment works, it is assumed that the site is an area where work is underway and the necessary equipment and materials are left. Nova Ulinia is not liable for damages caused by unauthorised entry to the area of maintenance or investment works. Ongoing maintenance or investment works on the premises of Nova Ulinia during the guest's stay are not grounds for reducing the price of the stay.
14.8. Nova Ulinia is not liable for damages incurred by Guests as a result of actions contrary to these Terms and Conditions.
15. Monitoring and security of the facility:
15.1. At Nova Ulinia, internal video surveillance is carried out in the public areas. Video monitoring does not cover the space of houses (apartments), guaranteeing full privacy of guests.
15.2. Persons present at the Nova Ulinia facility agree to the registration of their image as part of the monitoring system.
15.3. The purpose of monitoring is to:
1) increasing the level of safety of persons staying at the Nova Ulinia facility and protection of property,
2) prevention of devastation and theft on the premises of Nova Ulinia, as well as registration of events conducive to determining the offender of a misdemeanor or crime,
3) clarifying conflict situations and determining the perpetrators of reprehensible acts,
4) restriction of access to the Nova Ulinia facility for unauthorized and undesirable persons,
15.4. The video surveillance system includes, in particular, cameras, recorders, wiring and software, as well as a station that receives images from cameras and recorders (recorder).
15.5. Monitoring works around the clock.
15.6. Registration and recording on the data medium, only the image from the cameras of the video surveillance system is subject.
15.7. Observation and recording in the monitoring of the image of events is carried out with respect for human dignity. It must not be conducted in a way that discriminates against observed persons, in particular on the basis of gender, race, ethnicity, views or creed.
15.8. The provision of recordings is possible to authorized authorities or institutions, e.g. the police, courts and prosecutors, etc., after they have indicated the factual and legal basis, and to other entities if they demonstrate the existence of a legal interest in making available. The provision takes place after the administrator of the Nova Ulinia facility has given consent or in the event of its absence by a designated employee.
15.9. Where necessary, as well as capacities, elements of the monitoring system will be improved, replaced and expanded, after prior consultation with the supervisory authority.
3.10pm. In order to increase security, Nova Ulinia is covered by a 24-hour security agency and an alarm system.
16. Complaints:
16.1. Guests have the right to lodge complaints regarding their reservation and stay at Nova Ulinia.
16.2. Nova Ulinia does not provide a permanent staff presence at the property. In the absence of staff, Nova Ulinia allows constant telephone or e-mail contact according to the current contact details posted on the website www.novaulinia.pl.
16.3. The complaint should be submitted in writing or by e-mail according to the current contact details of the Nova Ulinia facility. In urgent and untimely matters, the complaint should be submitted in person or by phone according to the current contact details posted on the website www.novaulinia.pl.
16.4. The complaint should be filed immediately after the occurrence of the circumstances to which it is supposed to concern.
16.5. Complaints will be processed by the Nova Ulinia Object within 14 days from the date of the Guest submitting the complaint.
16.6. The consumer may use out-of-court ways of dealing with complaints and pursuing claims, in particular mediation procedures provided by provincial inspectorates of the Trade Inspection or permanent arbitration courts to the consumer operating at the Provincial Inspectorates of Trade Inspection. More information is available on consumer advocacy or trade inspection websites. In addition, disputes involving Consumers can be resolved out-of-court through the platform of the online dispute resolution system between consumers and entrepreneurs available at http://ec.europa.eu/consumers/odr/
17. Final provisions:
17.1. In matters not regulated by these Regulations, the provisions of the Civil Code and other provisions of generally applicable law shall apply.
17.2. Nova Ulinia reserves the right to amend these Terms and Conditions, provided that the version of the Terms and Conditions applicable at the time of booking by the Guest applies to reservations made prior to the change of the Regulations.

1. General provisions:
1.1. These regulations define the rules for using the swimming pool located on the premises under the name “Nova Ulinia”, located at Ulinia 1N, 84-352 Ulinia.
1.3. Before entering Nova Ulinia and using the swimming pool, guests and their accompanying persons must read and comply with these Terms and Conditions throughout their stay. Staying in the pool area is tantamount to familiarizing and accepting the provisions of these regulations.
1.4. These regulations remain for inspection in the facility. The content of the regulations has been implicated by Nova Ulinia on the official website of the facility at www.novaulinia.pl in a way that allows obtaining, reproducing and recording the contents of the regulations using the ICT system used by the Nova Ulinia facility.
2. Hours of availability:
The outdoor swimming pool is open from May to October daily from 10.00 to 20.00. With the permission of the Nova Ulinia service, it is possible to use the swimming pool even after 20:00.
3. Pool Properties:
3.1. The dimensions of the pool are: length - 11 meters, width - 3.9 meters (total area: 42.9 m 2).
3.2. The depth of the pool is: 1.4 meters (one plane of the bottom).
3.3. The pool is equipped with a countercurrent for swimming.
3.4. The water in the pool, as far as possible, is heated to temperatures in the range of 28-30 ° C. The temperature of the water in the pool can be variable depending on the air temperature and weather conditions. Nova Ulinia is not responsible for improper pool water temperature.
3.5. Water parameters, treatment and filtration are constantly monitored.
4. General rules:
4.1. All guests in the swimming pool are required to comply with the instructions of Nova Ulinia. Guests who violate the rules of use of the pool and do not respond to instructions from the staff may be required to leave Nova Ulinia as part of an immediate check-out due to the guest's fault.
4.2. It is forbidden to create hazardous situations, including in particular pushing into the water, jumping, running, destroying furniture, equipment or other elements of the pool zone, entering areas with vegetation and bringing sand and mud with stones from them into the zone with the pool.
4.3. People with unstable health can only use the pool under the condition of extreme caution and having consulted their doctor beforehand.
4.4. It is strictly forbidden to bring glass objects into the pool area, i.e. glasses, bottles, containers, sharp tools and dangerous objects. In each house (apartment) there are safe transparent beverage cups permissible for use within the pool area.
4.5. It is forbidden to bring and consume alcohol, psychotropic drugs and drugs into the pool area. People under the influence of these or other narcotic drugs are prohibited from entering the pool area. Failure to comply with the prohibitions results in inviting guests from the property.
4.6. In winter, entering the pool or the pool blind is prohibited.
4.7. The pool is not a guarded swimming area. The use of the pool is possible under the sole responsibility of the guests and its accompanying persons. Nova Ulinia is not liable for any damage caused by the use of the swimming pool, except for damage caused by the intentional fault of Nova Ulinia.
4.8. For the safety of bathers, it is recommended to observe each other and, if necessary, provide assistance.
4.9. In the pool area (on white ceramic slabs), for safety reasons, it is strictly forbidden to ride a bicycle, scooter, roller skates or other similar recreational means.
4.10pm. Nova Ulinia does not accept any liability for accidents, loss of health, personal injury or death of Guests resulting from actions contrary to these Terms and Conditions.
5. Additional accessories for guests:
5.1. Guests are provided with additional bath towels in their homes (apartments) during the life of the pool. Bath towels are gray in color.
6. Minors and disabled persons:
6.1. The swimming pool is an unguarded facility, therefore minors and disabled persons must be under the care of adults or their guardians.
6.2. Children under the age of 18 and persons with disabilities may stay in the swimming pool only under the supervision of an adult guardian, wholly responsible for the child or disabled person throughout their stay at Nova Ulinia.
7. Hygiene rules:
7.1. Each swimming pool user is required to wash their entire body before entering the pool.
7.2. It is forbidden to use the pool for people with damaged skin, ringworm, wounds, cuts, infectious diseases and diseases that may pose a risk of aspiration, including in particular epilepsy and imbalances.
7.3. Guests who use the pool, including children, should wear a suitable swimsuit covering all intimate parts of the body.
7.4. It is forbidden to throw food and any other objects into the pool, including stones from the green spaces of the facility, that could contaminate the water.
8. Final Provisions:
8.1. In matters not regulated by these Terms and Conditions, the provisions of the general booking regulations and the rules of stay at Nova Ulinia and the provisions of generally applicable law shall apply.

1. General provisions:
1.1. These Terms and Conditions define the rules for the sale and execution of Vouchers within the scope of the Nova Ulinia facility, located at Ulinia 1N, 84-352 Ulinia.
1.3. Authorised person means a natural or legal person purchasing (Buyer) from the Exhibitor of a Voucher.
1.4. The exhibitor offers the following types of vouchers:
1) Amount Voucher — a voucher covering part of the costs of stay and additional services associated with staying in Nova Ulinia up to the amount specified in the Voucher,
2) Stay Voucher — a voucher used to finance basic baskets of stay in Nova Ulinia by the number of hotel nights and within the type of accommodation specified in the Voucher.
1.5. Each of the Vouchers has its own individual identification number.
1.6. All Vouchers are registered by the Exhibitor.
1.7. The expiration date is on the Voucher. The expiration date of the Voucher is not subject to renewal. Vouchers may provide for restrictions on the availability of dates, in particular restrictions on stay in Nova Ulinia during the following dates: “long weekends”, Christmas, New Year's Eve, New Year's Eve, Easter holidays. A long weekend is a term for a weekend when the day immediately adjacent to Saturday and Sunday is also free from work, most often due to the statutory holiday during this period.
1.8. Along with the purchase of the Voucher, the Buyer declares that he has read the contents of these regulations, accepts in full the provisions of the Regulations and undertakes to comply with them.
1.9. Upon receipt of the Voucher, the Authorized Party declares that he has read the contents of these regulations, accepts in full the provisions of the Regulations and undertakes to comply with them.
1.10pm. These Terms and Conditions are an integral part of any order for the purchase of a Voucher by the Buyer.
1.11pm. These regulations remain for inspection at the reception of the facility. The content of the regulations has been implicated by Nova Ulinia on the official website of the facility at www.novaulinia.pl, in a way that allows obtaining, reproducing and recording the contents of the regulations using the ICT system used by Nova Ulinia.
2. Voucher Acquisition Rules:
2.1. The voucher can be purchased at Nova Ulinia, or by means of distance communication, on the basis of a previously placed order, specified in detail under point 3.
2.2. In the case of a Stay Voucher, the Exhibitor will specify in the Voucher the amount of hotel dates paid as part of the Voucher and the type of accommodation or the amount of costs of stay that the Voucher will cover. The Buyer declares that he knows that the order of the Voucher entails an obligation to pay.
2.3. The Issuer will deliver the Voucher in electronic form to the e-mail address indicated as part of the order or in paper form to the address indicated as part of the order.
2.4. The Buyer undertakes to pay for the Voucher in an amount equal to the value of the Voucher in accordance with the current Exhibitor's price list.
2.5. The Exhibitor shall document each transaction in accordance with applicable regulations. If you wish to document the transaction with a VAT invoice, you must report this fact at the time of booking and provide the data of the buyer. Willingness to receive a VAT invoice must be reported before the completion of the payment transaction. After closing the transaction with a receipt, it is not possible to issue a sales invoice.
3. Purchase of distance voucher by consumer:
3.1. The Exhibitor enables the purchase of Vouchers remaining in its offer via an automated online system available at www.novaulinia.pl. The rules and mode of operation of the automatic system are determined by an external service provider within the framework of the functionality and available system regulations.
3.2. If the Buyer expresses the will to conclude a distance Voucher purchase agreement, the Exhibitor shall inform the Buyer of the total amount for which the Voucher will pay and the type of benefits associated with it, along with possible costs of delivery of the Voucher to the Buyer or the Authorized.
3.3. Placing an order takes place by filling in mandatory forms in the automated online order system and accepting the terms of the transaction following through the obligation to pay using the “Pay Now” button or the equivalent button, which means the order with the obligation to pay
3.4. Payments are made directly during the online booking process using electronic payments, but not later than within 5 days from the date of placing the order for the Voucher. Failure to pay on time results in the expiration of the order.
3.5. After placing and paying the order, the Exhibitor immediately confirms the conclusion of the distance contract and its conditions, proceeding to the execution of the order and issuing the Voucher.
3.6. The Issuer will deliver the Voucher in electronic form to the e-mail address indicated as part of the order or in paper form to the address indicated as part of the order, immediately after receipt of payment.
3.7. The Buyer has the right to withdraw from the contract concluded at a distance within 14 days without giving any reason and incurring additional costs, notifying the Exhibitor about it to the address of the company or to the address rezerwacja@novaulinia.pl together with the presentation of proof of purchase. In order to withdraw from the contract, the Buyer may submit a statement on the model statement available at https://www.uokik.gov.pl/download.php?id=1216.
3.8. In case of effective and lawful withdrawal from the Agreement, the contract shall be deemed not concluded and the Voucher will be canceled.
3.9. The Exhibitor shall immediately send the Buyer a confirmation of receipt of the declaration of intent on withdrawal from the sales contract, to the e-mail address indicated by the Buyer with information about the cancellation of the Voucher.
3.10pm. The period referred to in point 3.7 begins from the date of delivery of the Voucher to the Buyer or the Authorized (as directed in the order).
3.11pm. The Buyer may withdraw from the contract by submitting a declaration of withdrawal from the contract to the Exhibitor before the expiry of the withdrawal deadline.
3.12pm. The payment will be returned no later than within 14 days, from the date of receipt by the Issuer of the declaration of withdrawal from the contract.
3.13pm. The Issuer shall refund the payment using the same method of payment as used by the Buyer, unless the Buyer has expressly agreed to another method of return.
3.14pm. The right of withdrawal shall not be granted in the event of the performance of the service by the Exhibitor and in the case of purchasing a Voucher at Nova Ulinia.
3.15pm. The right to withdraw from the contract concluded at a distance is provided for the Buyer, who is entitled to the status of a consumer. A consumer shall be considered to be a natural person carrying out a legal transaction with an entrepreneur not directly related to his business or professional activities.
3.16pm. Regulations concerning the consumer included in these Regulations shall also apply mutatis mutandis to a natural person concluding a contract directly related to his/her business activity, when it appears from the content of the contract that person does not have a professional character, resulting in particular from the subject of the business activity performed by him, made available on the basis of the provisions on the Central Register and Information on Economic Activity.
4. Rules of use:
4.1. The Voucher may be processed by the Authorised or other holder who has taken possession of the Voucher with the consent of the Authorised, within the Nova Ulinia facility located at Ulinia 1N, 84-352 Ulinia.
4.2. In the case of a Stay Voucher, the Exhibitor will specify in the Voucher the amount of hotel dates paid as part of the Voucher and the type of accommodation or the amount of costs of stay that the Voucher will cover.
4.3. The Issuer shall not be liable for the loss or damage of the Voucher, from the date of its transfer to the Buyer or the Authorised Member.
4.4. The purchase of a voucher does not mean booking selected services at Nova Ulinia and does not entitle you to enter out of order.
4.5. The Voucher is obliged to pre-book his stay on a general basis at Nova Ulinia in person, by phone or by e-mail. Due to the service of the Voucher, the possibility of booking a stay is excluded via an automated reservation system on the Nova Ulinia website, available at www.novaulinia.pl,
4.6. The basis for performing the service by the Exhibitor is the prior presentation of the Voucher or providing the Voucher number.
4.7. The voucher can be processed according to the scope specified in the content of the Voucher or up to the amount indicated on the Voucher for the purchase of a stay or services:
1) The amount voucher reduces the price of the total stay and additional services by the gross amount for which the voucher was issued. In the case of an Amount Voucher, the Eligible is not entitled to receive a refund of the rest if the entire amount for which the Voucher was issued is not used. If the price for the service exceeds the value of the Voucher, the eligible or other holder of the Voucher is obliged to pay the difference according to the current price list of the stay at Nova Ulinia.
2) The stay voucher covers the entire basic costs of the stay by the number of hotel nights and the type of accommodation specified in the content of the Voucher. In the case of a Residence Voucher, the Authorised is not entitled to receive a refund of the equivalent of the unused period of stay covered. In the event that the period of stay exceeds the number of days specified in the Voucher, the Authorised or other holder of the Voucher is obliged to pay the difference according to the current price list of the stay at Nova Ulinia.
4.8. The voucher must be completed once and in full.
4.9. The Exhibitor has the right to refuse the implementation of the Voucher in the following cases:
1) expiry of the validity of the Voucher,
2) damage to the Voucher preventing the individual identification number from being read,
3) no prior reservation has been made in accordance with paragraph 2.4.
4.10pm. The implementation of the Voucher by the holder (bearer) will constitute a valid transaction even if the holder (bearer) comes into possession of the Voucher in an unauthorised manner.
4.11pm. A person using a Voucher as part of a stay at Nova Ulinia is subject to the laws and obligations set out in the current general terms and conditions for booking and staying at Nova Ulinia.
5. Complaints:
5.1. All complaints related to the Voucher, excluding complaints of services provided for the Voucher (which are subject to the regulations of the general booking regulations and rules of stay in Nova Ulinia), will be considered by the Seller within 14 days from the date of submitting a written complaint by the Buyer or the Voucher or its authorized holder. Complaints should be submitted to Nova Ulinia.
5.2. The consumer may use out-of-court ways of dealing with complaints and pursuing claims, in particular mediation procedures provided by provincial inspectorates of the Trade Inspection or permanent consumer arbitration courts operating at the Provincial Inspectorates of Trade Inspection. More information is available on consumer advocacy or trade inspection websites. 5.3. Subjecting a dispute to an out-of-court method of settlement requires the consent of both parties in any case.
6. Final provisions:
6.1. A voucher within the meaning of applicable law is not an electronic payment instrument, including it is not a payment card.
6.2. The loss of the Voucher after its delivery by the Seller is the responsibility of the Buyer, the Authorised or the Voucher Holder respectively. In the event of loss of the Voucher, the Customer or the Holder shall have the right to perform the service provided that proof of purchase of the Voucher is presented.
6.3. To all matters not regulated in these Terms and Conditions, the provisions of generally applicable law shall apply.
6.4. Nova Ulinia reserves the right to amend these regulations, provided that Vouchers purchased prior to the amendment of the Regulations shall apply the version of the Regulations in force at the time of placing the purchase of the Voucher by the Buyer.

The purpose of the processing of personal data is to carry out the lease and provide hotel services or other similar services, which at your request are provided by the property. The purpose of using video surveillance is to protect you and other people staying on the premises or in its vicinity. The use of the obtained data is necessary in order to fulfill the rights and obligations of both Nova Ulinia facility and you related to the performance of the contract concluded between the parties, including in particular:
1) handling the reservation,
2) performance of obligations arising from the contract concluded with the facility,
3) performance of obligations arising from the provisions of law,
4) implementation of marketing activities,
5) customer satisfaction surveys,
6) ensuring the safety of property and employees of the facility (including video monitoring),
7) communication with customers and contractors,
8) the provision of hotel services,
9) adapting the services of the facility to the specific requirements of the guest,
10) establishing, pursuing or defending claims,
11) documenting the course of the provision of qualified first aid by the rescuer, in particular during active time spending;
4. We process your personal data collected as part of bookings, orders and fulfillment of stays and provision of additional services in a way that guarantees protection against their unlawful dissemination. The facility has a policy on the security of personal data and the mechanism for controlling and securing your data.
5. In the case of booking a stay at the property via the reservation portal, the categories of your personal data provided to the facility by these entities may include, in particular, your name, date of stay, e-mail address, telephone number. Information about the exact source from which the property obtained personal data can be obtained at Nova Ulinia.
6. We will process the collected data only to the extent necessary to achieve the purposes for which they were obtained, the basis of which is:
1) conclusion and implementation of an agreement with the facility (Article 6 (1) (b) of the GDPR),
2) performance of obligations arising from the provisions of law (Article 6 (1) (c) of the GDPR),
3) consent, regarding data that are not necessary for the conclusion and performance of the contract with the facility, in particular in the field of marketing activities and communication with customers and contractors (Article 6 (1) (a) of the GDPR),
4) express consent in the case of processing data on the health of the guest of the facility (Article 9 (2) (a) of the GDPR),
5) the legitimate interest of the facility in the field of customer satisfaction testing, ensuring the safety of property and employees of the facility (Article 6 (1) (f) of the GDPR),
6) establishing, pursuing or defending claims (Article 6 (1) (f) and Article 9 (2) (f) of the GDPR);
7. We entrust further processing of data to third parties, only to the extent necessary to fulfill statutory obligations and necessary to perform contracts and legally protected interests of the facility, including in particular:
1) entities to whom the facility will outsource services related to the processing of personal data, e.g. IT service providers, accounting office, law firm and companies, bodies and institutions to which the object will send correspondence or inquiries on your behalf and at your request, e.g. transport companies,
2) bodies authorized under the provisions of law, including courts and other public administration bodies.
8. Your data will be processed and stored for the period necessary to perform the contract and for the period of limitation of all claims related to the contract, as well as in accordance with archiving deadlines regulated by law, including in particular for a full 6 years, which results from the limitation of claims in accordance with the Civil Code, and in the case of data processed solely on the basis of consent until such consent is withdrawn. Data processed as part of the facility monitoring system will be stored for up to 3 months, unless due to special circumstances, e.g. an accident), the monitoring record will have to be kept longer, including for the duration of possible proceedings conducted under the provisions of the Act.
9. We enable access to the content collected about you and rectify, delete, limit processing, ensure the right to data portability, the right to withdraw consent at any time without affecting the lawfulness of the processing, subject to data processing to the extent required by law or for the purpose necessary for the performance of the contract.
10. We do not transfer your data to a third country or an international organization, except for authorities authorized by law.
11. Personal data processed will not be subject to automated decision-making, including decisions resulting from profiling.
12. 14. If you consider that despite our actions and efforts, the data is processed inappropriately or unlawfully, you have the right to lodge a complaint with the President of the Office for Personal Data Protection.
